As the pandemic continues to ravage the country, courts and law firms continue to balance health and safety with the needs of litigants to move their cases forward. The panelists will share in-the-trenches experience from the perspective of a judge, a jury consultant, and advocates who have handled remote trials and arbitrations (plaintiff and defendant).  The program will focus on both practical and strategic considerations and lessons learned in navigating the ongoing reality of remote discovery and trials and how technology has become an integral part of trials, practically and legislatively.  The panelists will discuss the pros and cons of remote litigation, opportunities to make improvements, and what the future may hold as the pandemic continues and thereafter.  Hon. Brad Seligman, Supervising Judge of Complex litigation in Alameda,  will share his perspective conducting remote jury trials, the challenges and benefits to lawyers, witnesses and jurors, and how the local rules have been modified to accommodate this current reality.  Also participating will be Trial Consultant Richard Gabriel of Decision Analysis, Inc. and Founder of the Online Courtroom Project, which has been tracking remote proceeding across the country since the beginning of the pandemic, and is editor and author of The Online Courtroom: The Future of Remote Technology in the Litigation Process,, which will be published this Spring by the ABA.  He will offer insight on what he has observed taking place in courtrooms nationwide, the logistics of preparing and presenting an effective trial strategy with the use of technology, and how it can be improved.
